Terms and Conditions for Indy Bloom Design

Welcome to Indy Bloom Design. These Terms and Conditions (“Terms”) govern your access to and use of our website, products, and services. By accessing our website, placing an order, or using our products, you agree to be bound by these Terms. If you do not agree, please do not use our website or purchase our products.

1. General Information

This website is owned and operated by Indy Bloom Design. Throughout the site, the terms “we,” “us,” and “our” refer to Indy Bloom Design. We offer wallpapers, surface pattern designs, and related products and services through this website.

We reserve the right to update, modify, or replace any part of these Terms at any time by posting changes to this page. Your continued use of the website after any changes are posted constitutes your acceptance of those changes.

2. Products and Product Information

All products are subject to availability. We reserve the right to discontinue or modify products at any time without notice.

Because our products are custom printed, slight variations may occur, including but not limited to color, scale, texture, and pattern placement. Colors may also appear differently depending on your screen, device, lighting, and material selected. We strongly recommend ordering a sample before placing a full order.

It is the customer’s responsibility to review all product details, measurements, and specifications prior to purchase. Indy Bloom Design is not responsible for errors resulting from incorrect measurements, miscalculated quantities, or failure to order a sample before purchase.

3. Orders, Pricing, and Payment

All prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, inaccuracies, or omissions at any time, including after an order has been submitted.

By placing an order, you agree to provide current, complete, and accurate billing, shipping, and payment information. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that appear to be placed by dealers, resellers, or distributors without authorization.

4. Shipping and Delivery

We aim to process and ship orders within the timeframes stated on our website, but all shipping and delivery dates are estimates only and are not guaranteed.

Once an order has shipped, Indy Bloom Design is not responsible for delays, delivery failures, or damage caused by the carrier. Customers are responsible for ensuring that shipping information is accurate at the time of purchase. We are not responsible for packages lost, delayed, or misdelivered due to incorrect address information provided by the customer.

International customers are responsible for any customs duties, import taxes, VAT, brokerage fees, or similar charges imposed by their country or carrier.

5. Returns, Refunds, and Cancellations

Due to the custom, made-to-order nature of our products, all sales are final. We do not accept returns, cancellations, or offer refunds for change of mind, incorrect measurements, color expectations, or ordering the wrong quantity from imporper measuring.

If your order arrives damaged, defective, or incorrect due to an error on our part, you must contact us within seven (7) days of delivery and provide clear photographs of the issue. If approved, we may, at our discretion, offer a replacement, store credit, or other appropriate remedy.

6. Installation and Customer Responsibility

Customers are solely responsible for ensuring that wallpaper is suitable for their intended surface and environment before purchase and installation. We strongly recommend reviewing all installation instructions, preparing surfaces properly, and using a qualified professional installer when appropriate.

Indy Bloom Design is not responsible for installation issues arising from, including but not limited to, improper wall preparation, textured or damaged surfaces, moisture or humidity, incompatible paints or primers, use of third-party tools or adhesives, or installer error.

Customers should inspect all wallpaper carefully before installation. Do not install any product you believe may be defective or incorrect. Installation of the product constitutes acceptance of the product as received.

7. Assumption of Risk

By purchasing, installing, or using Indy Bloom Design products, the customer acknowledges and assumes all risks associated with the installation, use, and presence of wallpaper products in a residential or commercial space. This includes, without limitation, the risk of product detachment, falling materials, and any resulting property damage, bodily injury, or other loss.

8. Limitation of Liability

To the fullest extent permitted by law, Indy Bloom Design shall not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages arising out of or related to the purchase, installation, use, misuse, or inability to use our products or services.

This includes, without limitation, damages related to wallpaper detachment or failure, improper installation or surface preparation, environmental conditions beyond our control, use of third-party adhesives or tools, personal injury, medical expenses, loss of use, loss of enjoyment, and property damage beyond the purchase price of the product.

To the fullest extent permitted by law, our total liability for any claim relating to any product or order shall not exceed the amount paid by the customer for the specific product giving rise to the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Indy Bloom Design, its owners, officers, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your purchase, installation, use, misuse, resale, or distribution of our products, your violation of these Terms, or your violation of any law or the rights of a third party.

10. Intellectual Property

All artwork, designs, patterns, images, graphics, text, logos, and other content on this website are the exclusive property of Indy Bloom Design and are protected by copyright, trademark, and other applicable intellectual property laws.

No content from this website may be copied, reproduced, distributed, modified, displayed, sold, or used in any way without our prior written consent.

11. User-Generated Content

If you tag @indybloomdesign, use branded hashtags, submit photos, reviews, testimonials, or otherwise share content featuring our products, you grant Indy Bloom Design a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, publish, display, and share that content for marketing, promotional, advertising, and business purposes, with or without credit, unless otherwise agreed in writing.

12. Website Use

You agree not to use this website for any unlawful or unauthorized purpose, or in any way that could harm, disable, overburden, or impair the site or interfere with any other party’s use of the site.

13. Disclaimer of Warranties

Except as expressly stated by Indy Bloom Design in writing, all products and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
